General Risk Waiver
Despite careful and proper preparation, instruction, medical advice, conditioning and equipment, there is still a risk of serious injury when participating in any recreational activity/program. Understandably, not all hazards and dangers can be foreseen. Participants must understand certain risks, dangers and injuries due to acts of nature, inclement weather, slipping, falling, equipment failure, failure in supervision, premises defects and all other circumstances inherent to recreational activities/programs exist. In this regard, it must be recognized that it is impossible for Seal Swimming to guarantee absolute safety.
RELEASE / INDEMNIFICATION OF ALL CLAIMS AND COVENANT NOT TO SUE: THIS IS A LEGALLY BINDING AGREEMENT. By accepting this agreement, you give up your right to bring a court action to recover compensation or obtain any other remedy for any injury to you or your family or ward, or to your property or for you or your family member or ward’s death however caused arising out of participation in the registered program/activity, now or any time in the future.
You MUST agree to the following liability statement before the registration can be completed:
I recognize and agree that risk of injury or potential health risk may be involved in participation in the program/activity. I hereby willingly assume such risk of injury or health risk for myself or my family or ward for whom I am in law responsible and assume full responsibility during and after my/their participation in the program/activity. In consideration of the acceptance of my application and the permission to participate in the program/activity I, for myself, my heirs, executors, administrators, successors and assigns HEREBY RELEASE, WAIVE, AND FOREVER DISCHARGE Seal Swimming, all other organizations, associations, and companies associated with any of the programs offered by Seal Swimming, and all of their respective agents, employees, officials, servants, contractors, representatives, elected and appointed officials, successors and assigns OF AND FROM ALL claims, demands, damages, costs and actions whatsoever and howsoever caused, arising or to arise by reason of my/their participation in the program or any of its associated activities.
Payment Authorization
I represent and warrant that if I am purchasing something or paying for a service from Seal Swimming or from other merchants through Seal Swimming that (i) any credit card information I supply is true and complete, (ii) charges incurred by me will be honoured by my credit card company or financial institution, and (iii) I will pay the charges incurred by me at the posted prices, including any applicable taxes, fees, and penalties.
I hereby authorize (if online payment is made or autopay information is provided) Seal Swimming to charge my credit card account. I understand that I am responsible for payment whether or not my student attends classes in accordance with Seal Swimming's Make-Up, Cancellation and Refund Policy.
Should I dispute a charge through my financial institution this will constitute a breach of contract possibly resulting in, but not limited to, penalties, additional fees, collection, legal action, and/or termination of any and/or all current and future services.
Make-Up, Refund, and Cancellation Policy
Refund Policy
If a refund or cancellation request is made prior to the swim session Start Date, a monetary refund will be available, less a $50 or 25% processing fee, whichever is less.
If a refund or cancellation request is made on or after the swim session Start Date, no monetary refund will be available should a student withdraw.
In the event that a medical emergency has occurred and a doctor's note submitted with the withdrawal request, a credit towards a future registration, within six months of the withdrawal, may be provided at the sole discretion of Seal.
Credits are non-refundable and can be used only for Seal locations and products.
All requests for monetary refunds or credits must be made in writing via email to info@sealswimming.ca.
Missed Classes:
I agree that no make-up class or other financial credit/refund will be available in connection with a missed class other than if cancellation of the class is initiated by Seal Swimming.
Cancellation of Classes by Seal Swimming:
If a class cancellation is initiated by Seal prior to the date of the first class, due to scheduling demands, a replacement class will be made fitting the same class ratios and with a similar schedule unless a mutually agreeable replacement can be found.
If a class cancellation is initiated by Seal on or after the date of the first class, including any cancellation by a Governmental agency or facility operator, Seal Swimming reserves the right to either reschedule the missed class or apply a credit to the customer’s account. No refunds will be provided.
Termination of Registration:
I acknowledge that Seal Swimming reserves the right to terminate the registration of any participant(s) if, in their sole discretion, Seal Swimming’s management determines such termination to be in the best interest of the participant or the program.
Photography
Parents/guardians may take photos of their child during classes. Only your child is permitted to be in the photo.
Don't forget to tag @sealswimming if you are sharing your photos.
Staff reserve the right to view photos if there is any concern.
You accept that you or your child may be pictured/photographed by Seal Swimming and such material can be used by Seal Swimming. If you do not want your child to be photographed, please inform the Shift Lead on duty.
No photography of any kind is permitted in any Changing or Shower Facility.
Changing Rooms Access
Swimmers aged seven (7) and under may be accompanied by a parent in the changing room or washrooms of the parent’s gender.
All swimmers over the age of seven (7) are required to use the changing room designated for their gender.
Where a pool facility does not have universal change rooms, no parent is allowed to accompany their children in a changing room that is opposite to the parent’s gender.
Non-compliance may result in the parent’s removal from the facility and the swimmer’s removal from the program.
Open Showers Areas
Where no shower stalls are available, bathing attire must be worn in open shower areas. The use of showers is limited to registered participants only.

Pet Access to Facilities
No pets are permitted in the changing or shower facility. Where an accommodation for support animals is provided by Seal Swimming, support animals must be kept off the floor and not approach other facility users.
